Why "genuine rental intent" is about to determine which deductions you can claim

You might have heard whispers about changes to how the ATO views holiday homes that double as rental properties. Well, the guidance is now official, coming into effect from 1 July 2026. This is a significant shift for anyone with a holiday rental, and it's worth understanding the implications now.


Essentially, if you own a holiday home you also rent out, the ATO now expects it to be primarily used (or genuinely available) for generating rental income before you can claim expenses. This isn't just a minor tweak; it's about proving your intent.


If this primary use requirement isn't met, you could find that expenses you thought were deductible are entirely non-deductible. This means crucial deductions like interest, council rates, body corporate fees, and even repairs and maintenance could be at risk.


Even if your property is mainly for rent but you sneak in a week or two yourself during the off-season, you'll still need to meticulously apportion expenses to reflect that private use. The key takeaway here is that the ATO is tightening its focus on genuine rental intent. If you have a holiday home that you also rent out, it's crucial to review your usage patterns and record-keeping now, well before July 2026. This isn't just about compliance; it's about ensuring you're not caught off guard and can maximise your legitimate deductions.
